Warranty Duration:

The Mizerak or Murrey Pool Table is warranted to the original consumer purchase of a period of ninety (90) days from the date of purchase.

Warranty Coverage:

The manufacturer warrants to the original Consumer Purchaser that any Mizerak or Murrey Pool Table of its manufacture is free from defects in material and workmanship when used for the intended purpose under normal use and conditions. This warranty is void if the product has been damaged by accident, unreasonable use, negligence, improper service, failure to follow instructions provided with the product or other causes not arising out of defects in material and workmanship.

Warranty Performance:

During the above warranty period, the manufacturer shall repair or replace with a comparable model, and Mizerak or Murrey Pool Table, or component thereof, which may prove defective under normal use and proper care, and which our examination shall disclose to our satisfaction to be thus defective, please contact our Warranty Dept. Other than shipping requirements no charge will be made for such repair or replacement of in-warranty products. The manufacturer strongly recommends that the Product is insured for value prior to mailing.

NOTE:

Cloth not included in warranty. Should this product become defective due to material or workmanship within period, contact the Customer Service Department. This warranty is not transferable and does not cover normal wear and tear, or damage caused by improper handling, installation or use of this product. This warranty is also void if product is in any way abused, damaged, or modified from its original state, or if used for other than indoor residential use. This warranty gives the consumer specific legal rights, and may have other rights which may vary from state to state.

Warranty Disclaimers:

Any implied warranties arising out of this sale, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the above ninety (90) day warranty period. We shall not be liable for loss of use of the product or other consequential or incidental costs, expenses or damages incurred by the consumer of any other use. Some states do not allow the exclusion or limitation of implied warranties or consequential or incidental damages, so the above limitations or exclusions may not apply to you.

Legal Remedies:

This warranty gives you specific legal rights and you may also have other rights which may vary from state to state.

Possible Damages:

The manufacturer and shipping companies do their best to ensure that your table arrives on time and without any damage. However, sometimes, damage does occur in shipping. It is therefore very important that you inspect the table before signing the delivery receipt. Take your time when you receive the table, and make sure you are satisfied before signing. Once you sign, you have absolved the shipping company of any responsibility and it is almost impossible to have a claim honored. If there is a problem, make sure the driver clearly writes the problem on the delivery receipt, and please contact us as soon as possible.

Returns:

Due to the "custom assembly" nature of each pool table, orders may not be cancelled once placed. Please allow 1-2 weeks for merchandise to ship. Returns are generally not allowed. However, returned merchandise will not be accepted by the manufacturer without written authorization. It must be shipped with prepaid transportation. Returns sent transportation collect will not be accepted. Claims for defective merchandise must be made within 7 days of shipment. All returns are subject to restocking charge not to exceed 20%. Shortages:

If shipment is not delivered to you in accordance with quantity of cartons and packages as shown on bill of lading and freight bill, do not accept until shortage is noted on freight bill or delivery receipt. Inspect all packages to be sure they have not been opened. If pilfering is suspected, notify delivery carrier so they can inspect packages as they are opened. Check contents of your package(s) against enclosed packing list carefully. Small items are often overlooked as part of packing materials. If shortages are discovered not attributable to carrier, notify Escalade Sports or Wowshopper in writing within 2 days after receipt of order. Failure to make such notification negates loss claims. All shortages must be reported by carton number. Claims for shortages must be make within 7 days from receipt.
